DETROIT – All eyes are on a lawyer who plans to challenge the constitutionality of the city's recently passed "no-spend" policy for municipal elections next year. In response, the council has ordered two staffers to investigate Mayor Mike Duggan's use of the money he collected to fund personal expenses.
The council's Office of Legal Counsel released a statement Wednesday saying Duggan's use of the money may violate the city's Campaign Finance Law.
The legal office cited information released by Duggan's campaign's finance director, Craig Hickey, and by a senior assistant city attorney's office about a June 5, 2011, call Duggan received for campaign funds.
On June 19, Duggan's campaign forwarded an email to him from Hickey stating that the $2,400 he raised for himself was being used to buy "an official T-shirt" for his wife. The campaign advised Hickey the official T-shirt cost about $45.
In addition, the document said, Duggan was using a campaign money that he had collected from a donor.
"The city, in the light of those facts, may be required to seek judicial review of these actions on the grounds that the City has violated the prohibition on 'unjust enrichment,' which prohibits improper payments to members of public officials."
The legal office noted that city officials "are required to make available to those with special needs" that a list of approved, legal expenses.
Hickey said his client also obtained an annual $40,000 annual stipend from his campaign to pay for a number of expenses, such as a new computer system and equipment. The email sent from Duggan's campaign to the legal staff says the salary is for his wife's campaign and not for Duggan's.
"In light of your inquiry, council has decided to hold an investigation regarding these two allegations," the legal office said in the statement.
A councilman, Ken Cockrum, who was the top Democratic and one-third of the council when Duggan became city's first openly gay and transgender mayor in 2003, said last year the council has "got to take a hard look" at "fundraising for political work." Duggan and his campaign "need to learn how to actually run an organization and not just put out press releases that are political."
Cockrum said the case would raise questions about how and why Duggan's campaign "is doing all of this fundraising and sending money out for things like campaign posters, the city mail, things like that."
Duggan campaign treasurer John Smith said last year he did not recall receiving
